PURPOSE
This Charity Auction Disclosure explains how auction events are structured, how charitable allocations work, and the terms that apply to bidders and winning participants. It is intended to be read together with our Terms of Service, our Privacy Policy, the event-specific auction terms, the applicable charity partner's disclosures, and any other supplemental terms posted for a particular auction. All of these documents are available at luxulcollective.com.
Charity auction participation may be subject to jurisdictional limitations. LUXUL COLLECTIVE complies with applicable charitable solicitation registration requirements. Charity auctions are not available where prohibited by law. We reserve the right to restrict participation from jurisdictions where we are not registered or permitted to solicit charitable contributions.

CHARITABLE STRUCTURE
For auction events, ninety percent (90%) of auction proceeds, or such other amount as disclosed for a particular auction, may be directed to the applicable charity partner associated with that auction. The remaining portion may be used to cover operating, fulfillment, payment processing, administrative, platform, or related costs, unless otherwise expressly stated for a specific auction.

TWO VERTICALS AND GIVING MODEL
LUXUL COLLECTIVE operates under one legal entity with two distinct verticals: an e-commerce vertical and a charity auction vertical. The e-commerce vertical may direct twenty percent (20%) of profits to global causes, charitable initiatives, or partner organizations as described in the applicable site terms or related charitable program disclosures. The charity auction vertical is separate and governed by this Disclosure and any event-specific auction terms.

BIDDER AGREEMENT
By placing a bid, you acknowledge that you have read the event-specific auction terms, understand that bids are binding, and agree to pay if you are the winning bidder under the stated rules.

FINAL SALE
Auction items are sold on a final-sale basis unless the event-specific terms expressly state otherwise. There are no returns, exchanges, or cancellations after a winning bid is placed, except where required by law.

DISPUTE RESOLUTION
Any dispute relating to an auction item, including item condition, description, fulfillment, or nonreceipt, must be directed to the applicable charity partner or event host, as those items are offered by or on behalf of that organization. LUXUL COLLECTIVE facilitates payment collection and transfers funds to the charity partner upon fulfillment confirmation or other event-specific reconciliation, as applicable. We are not responsible for item-related disputes and handle only platform, payment-processing coordination, or administrative issues within our control.

ITEM DESCRIPTIONS
We work to describe auction items accurately, but descriptions, provenance, condition, size, color, availability, and other details may be approximate unless expressly guaranteed in writing.

TAX & RECEIPTS
Where the total amount paid for an auction item exceeds the fair market value of any goods or services received in exchange, a portion of the payment may qualify as a charitable contribution. For payments above seventy-five dollars ($75) where goods or services are received in exchange, a quid pro quo disclosure is required by the IRS and will be provided in the format required for the specific auction and applicable charity partner.
The charity partner, not LUXUL COLLECTIVE, is responsible for issuing any required written acknowledgment, charitable contribution receipt, or quid pro quo disclosure to winning bidders. LUXUL COLLECTIVE does not provide tax advice. Bidders should consult their own tax advisor to determine the deductibility of any payment made in connection with a charity auction.

PAYMENT TIMING
Winning bidders must complete payment within the timeframe stated in the event-specific auction terms. Failure to pay may result in forfeiture of the item and any associated bidding privileges.

DATA SHARING AND RETENTION
LUXUL COLLECTIVE may share bidder data with a charity partner only as needed for auction administration, payment confirmation, fulfillment, donor acknowledgment, and related operational purposes. Shared bidder data may include bid history, winner contact information, and payment confirmation. LUXUL COLLECTIVE may retain bidder data for accounting, payment processing, platform operations, community engagement, impact reporting, and brand growth, unless a bidder specifically opts out or requests deletion through LUXUL COLLECTIVE's privacy process. LUXUL COLLECTIVE does not automatically delete bidder data after each auction.

CHARITY PARTNER DATA USE
Charity partners may retain bidder data for donor records, acknowledgment, reporting, and relationship management purposes, and may include a clear marketing opt-in/opt-out mechanism in donor acknowledgment or thank-you communications. Each party is responsible for respecting opt-out requests received directly through its own channels. Charity partners must maintain their own public privacy policy and auction terms or disclosures that are consistent with this Disclosure and the governing MOU.

LEGAL STATUS AND COMPLIANCE
Charity partners are responsible for maintaining all registrations, renewals, annual filings, disclosures, and licensing obligations required for charitable solicitation, fundraising, cause marketing, auction promotion, or receipt of funds in the states where such obligations apply. If a charity partner's registration, tax-exempt status, or good standing changes, the charity partner must notify LUXUL COLLECTIVE promptly.

PUBLICITY AND IMPACT STORIES
General impact stories may be shared with the community. However, no identifiable bidder or winner information may be used publicly without the consent or approvals required by law and the applicable written instructions governing the event.
